᯽ disclaimer: If you’d like to commission me, I require that the client contact me first through either email ([email protected]) or social media private messages. If you reach out to me first, I’ll be more than happy to try and talk plans out with you!through commissioning me, you are confirming that you have read through, understand, and agree to these terms.general terms of service:
᯽ by ordering a NSFW commission, you are confirming that you are above the age of 18 at the time of the commission.
᯽ I have 3 slots available for commissions in order to help me balance my commissions with my everyday responsibilities outside of art. please do not request a commission while all these slots are full, as I will be forced to deny your requests.
᯽ commissions from me are not allowed to be used for commercial use, claimed as your own, or resold unless we negotiate otherwise.
᯽ payment is expected upfront, commissions will not be started until payment is received. you will have a week to deliver payment before the slot is offered to another client and/or voided.
᯽ payment will only be accepted in the form of paypal.
᯽ do not send money until I have confirmed that I will proceed with your commission and after prices have been negotiated and confirmed — paying without confirmation does not guarantee you a slot and it will be sent back.
᯽ the owner of the commission may reupload their commissioned art so long as there is at least one form of credit to me (@mccnofstars) through tagging, linking my carrd, and/or a link back to at least one of my art pages.
᯽ full refunds may be requested up until the sketch has been approved by the client. afterwards, the best I can give is a partial refund. (see Refund Policy in Section II).in-depth terms of service:
SECTION I. IMAGE COPYRIGHT
1. the artist (@mccnofstars) retains full and exclusive rights to the original artwork. the client MAY NOT claim it as their own or use it for anything other than personal use.
2. all commissioned artwork is for NONCOMMERCIAL purpose only, unless we negotiation otherwise. redistribution of my artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited. if you have any questions about this, please ask me BEFORE COMMISSIONING ME.
3. the client has my permission to repost the artwork wherever they would like, as long as at least one form of proper credit is given (forms of credit may include a link back to at least one of my art pages, tagging me, or linking my carrd) and my watermark/signature remains intact and unaltered.
4. prohibited actions:
᯽ altering my artwork in any way without asking for permission before hand, with the exception of cropping/resizing the image for an icon or other use.
᯽ use of my artwork as “references” for your own, whether tracing or re-purposing parts of the image.
᯽ claiming the artwork as your own.
if these terms are broken, you will be privately blacklisted from commissioning me and reported.SECTION II. PAYMENT INFORMATION
1. i accept payment in the form of USD. all USD payments will be taken via paypal only, and paypal offers a conversion option should you have currency that is not usd. any other form of payment will, more likely than not, be denied.
2. your commission will not be started until payment is received upfront in order to avoid art theft. this payment must be given within a week of the payment quote being given, or else the commission will be cancelled.
3. you are allowed to request a full refund up until the sketch has been approved and you have confirmed for me to continue working. any refund requests after approval of the sketch will depend on how far I am into the finished piece (note the Refund Policy bullet).
4. if a full refund is issued at the sketch portion of the process, the client will be prohibited to any rights to the sketch. If the sketch has been completed, it will be repurposed as a YCH to the public. the client’s character will be stripped to a base and will not be used in the YCH base. if the sketch isn’t completed, it will likely just be scrapped.
5. it is the client’s responsibility to alert me when the payment has been sent. sometimes a payment will not fall through and I won't know about it. if you fail to tell me that you've sent the payment within the week - and I know I absolutely haven't received the payment - then the week long deadline applies to you, and your commission will be cancelled if payment is not received.
6. refund policy:
᯽ if the commission is cancelled (by myself or the client) before the art has advanced beyond the sketch, then the client will receive a full refund.
᯽ if the client cancels the commission when work has been done beyond the sketch, the amount refunded will be on a case-by-case basis and up to the artist’s discretion. I do have a rough basis for refunds:
᯽ sketch: 100%
᯽ line: 50%
᯽ line and flat color: 0% (unless shading was included in the commission, then 15%)
᯽ no refunds will be given for completed or nearly completed commissions.
᯽ the artist reserves the right to cancel a commission at anytime, for any reason, and without explanation. you will be refunded accordingly in these cases.
᯽ if I cancel the commission due to my inability to complete it at any state, a full refund will be given.
᯽ if the client cancels once the sketch stage has been completed, the sketch will not be available for use by the client. It will be stripped of characteristics and instead used as a YCH to be sold to the public, or just erased entirely based on how far along the sketch is.SECTION III. CONTACT AND COMMUNICATION
1. discussion of commissions can be conducted via Instagram DMs (@mccnofstars) or by my email ([email protected]). messages on other platforms (Twitter, Tumblr, etc) may not be seen, as I’m not as active on them. please note that I may not see your messages immediately regardless of contact form.
2. visual reference guidelines:
• client must provide at least one clear and concise visual reference; please supplement the visual reference with any important information I may need to know to correctly draw the character.
• if you link to a gallery of your character’s artwork, I cannot promise your design will be done with 100% accuracy. design interpretations may be inconsistent between images and lessen my ability to accurately draw your character. shading on potential pieces will also play a part in this. i will try my best to get as accurate as I can, but I am only human and I cannot judge which interpretations are more accurate than others, especially without guidance.SECTION IV. WILL/WON'T DRAW
1. below is a general guideline for what I will or will not draw. please keep my art style in mind when ordering; I specialize in humanoid characters primarily. things outside my comfort zone might not be as high of quality as something I am used to doing, and if I’m lacking in skill enough, I may just deny it altogether for the time being. this is to avoid charging my clients for something that I do not have the skill to create for them — I will not scam you of your money by taking on requests I know I cannot deliver on. its unfair to my clients.
2. allowed content:
᯽ people/characters
᯽ couples/ships
᯽ fandoms
᯽ humanoid creatures (androids, elves, etc)
᯽ light NSFW (Lingerie, mildly sensual environments and expressions/interactions with ships)
᯽ medium NSFW (Nude figures, genitalia) These will be posted on my Patreon, not my main accounts.
᯽ gore/body horror
3. disallowed content:
᯽ characters intended to be or appearing underage in any sexual or suggestive context.
᯽ any sort of sexually violent content such as non-consensual intercourse (rape), sexual assault and/or harassment, vore, etc.
᯽ any sort of hateful content, such as racism, transphobia, homophobia, xenophobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.
᯽ social commentary, political content, propaganda or anything else of that sort.
᯽ zoophillic or necrophilic content
᯽ any form of NSFW that includes real people (characters are okay for me, real people are not.)
᯽ hardcore NSFW (Masturbation, intercourse, porn) This is due to lack of skill and is subject to change.
᯽ animals, furries or anthropomorphic characters. This is due to lack of skill and is subject to change.
᯽ anything else that I may not be completely comfortable with. I reserve the right to turn down any commission if I am uncomfortable with the content involved.
4. you must be over the age of 18 to commission adult content. I am a United States citizen and abide by United States laws. breaking this rule is EXTREMELY serious and will result in blacklisting/blocking on all social media, email, and any other means of contact. by ordering anything 18+/NSFW, you are agreeing that you are at or above the age of 18.SECTION V. WORKFLOW PROCESS
1. i work best when given some artistic freedom to create an image based on the characters you provide. i am happy to match a scene or pose that you have in mind, but please allow and expect some variation.
2. estimated date to completion. if there are any delays in completion of a commission, I will personally notify the customer.
᯽ completion of most commissions are generally estimated to take no more than roughly 1 to 3 weeks. if for any reason I cannot complete a commission within 50 days of ordering, I will issue a full refund.
3. works in progress (WIPS). certain commission types may or may not include a sketch approval stage. I will send any wips to the commissioner through whatever means of contact was established in order to set the commission in the first place. progress will be paused until the sketch is confirmed.
4. revisions and edits. if the commission type includes a sketch approval stage, any major changes or revisions must be made at this stage; this includes any significant changes to a character’s pose or body shape, or redrawing parts of the image.
• after the sketch has been approved, no major edits or changes will be made.
• if I, the artist, make any errors in the character design, accessories, or any other visual elements specified in the provided visual references, I will make these edits at no additional cost.
5. if you do not want me to post your commission online, you must tell me when you order.
